Terms and Conditions of Entry
General
1.Eligible entrants who propose a name for either tunnel forming part of the West Gate Tunnel Project (Submission) are entered into the West Gate Tunnels Name Submissions Lottery (Draw). Entry of a Submission is deemed acceptance of these terms and conditions of entry (Terms and Conditions).
2.The promoter of the Draw is the West Gate Tunnel Project, Major Road Projects Victoria, an administrative office within the Department of Transport (ABN 69 981 208 782) of Level 21, 180 Lonsdale Street, Melbourne VIC 3000 (Promoter).
3.Submissions will be accepted during a period commencing at 12.01am AEST on Sunday 16 February 2025 and closing at 11:59pm AEST on Monday 31 March 2025 (Promotion Period).
4.Entries must comply with the Terms and Conditions to be valid, as determined by the Promoter in its absolute discretion.
Prizes and Draw
5.This is a game of chance.
6.The Draw will take place at 9.00am (AEST) on Monday 5 May 2025 (Draw Date) in the presence of representatives from the Promoter and Transurban Limited (ABN 96 098 143 410) (Transburban).
7.The winner will be randomly drawn by an electronic draw process from all eligible entries received during the Promotion Period. The first valid entry will win the prize (Prize).
8.There is a maximum of one (1) Prize to be won in the Draw.
9.The Prize to be awarded to the winner of each Draw is:
- a) a $500 Shell Gift Card (see clauses 14 to 17 below);
- b) The opportunity to nominate a community organisation or registered charity to receive a donation valued at $2,500.
10.The Prize as outlined in clause 9(a) and (b) will be supplied by Transurban or an associate of Transurban.
11. Where the Prize winner nominates a community organisation or registered charity to receive a donation accordance with paragraph 9(b) above, Transurban reserves the right to approve any such nomination (and withholds the right to not make payment at its absolute discretion) and in doing so may consider whether the nominated community organisation or registered charity meets the requirements of “Grant recipients, eligibility and requirements” set out at https://www.transurban.com/communities/partnerships-and-grants/community-grants.
12. The winner will be notified by the Promotor of their success by either the phone number or email address provided with their entry. In the event that an entrant is not able to be contacted to be awarded their Prize and/or does not respond to the Promoter within 14 days of being notified, that Prize will be forfeited, and the Promoter will conduct a second random draw to select another winner for the Prize.
13. Once the winner has been contacted in accordance with clause 12, the Promoter will facilitate Transurban’s delivery of the Prize as outlined in clause 9(a) and (b) above to the winner.
Shell Gift Card Delivery
14. The Shell Gift Card can only be delivered via email.
15. The winner will receive the Shell Gift Card via email to their confirmed email address within 14 days of the Promotor receiving confirmation of the email address.
Shell Gift Card Terms

Eligibility & Entries
17.Subject to the other eligibility requirements of these Terms and Conditions, all Victorian residents may make a Submission.
18.If a winner of the Draw is under 18 years of age, the winner and/or their parent or legal guardian (as required by the Promoter) must sign a release form provided by the Promoter in order to accept the Prize:
- a) confirming acceptance of the Terms and Conditions;
- b) in the case of parents/guardians, accepting full responsibility for the winner in respect of the Prize;
- c) allowing the first name of the winner to be published on the Promoter’s website and affiliated websites and social media channels; and
- d) allowing the winner to be filmed and photographed in accordance with paragraph 26.
If the above release form is not provided within 14 days of the entrant being notified of the winning entry, the prize will be forfeited, and the Promoter may select another winner for the prize.
19.The following persons are ineligible to participate:
- a) directors and management of the Promoter or the Transurban Companies and their immediate families;
- b) officers, employees and contingent workers of the Promoter or the Transurban Companies and their immediate families;
- c) Members of the West Gate Tunnel Community Liaison Groups (CLGs) and their immediate families;
- d) Government agencies and/or private sector entities, including CPB Contractors Pty Limited (ACN 000 893 667) and John Holland Pty Ltd (ABN 11 004 282 268), which are in any way associated or connected with the West Gate Tunnel Project and their directors, management and employees and their immediate families; and
- e) retailers, suppliers, associated companies, and agencies of the Promoter or the Transurban Companies who are associated with this Promotion, and their directors, management and employees and their immediate families.
“immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
“Transurban Companies” means Transurban Limited (ABN 96 098 143 410), Queensland Motorways Management Pty Limited (ACN 010 630 921), Queensland Motorways Services Pty Limited (ACN 165 422 202) and the WestConnex Group.
“WestConnex Group” means (a) WCX AHT Pty Ltd (as trustee of the WCX Asset Hold Trust) and WCX PHT Pty Ltd (as trustee of the WCX Project Hold Trust) (together the WCX Entities); (b) each company in which the WCX Entities, whether individually or collectively, own (directly or indirectly) 50% or more of the voting shares; and (c) each company which is for the purposes of section 50AA of the Corporations Act 2001 under the “control” of the WCX Entities, whether individually or collectively.
20.Submissions must be submitted to the Promoter online during the Promotion Period. A Submission will be deemed valid at the sole discretion of the Promoter.
21.To make a Submission, entrants must submit a valid entry to the Promoter during the Promotion Period which nominates a name for one or both of the tunnels forming the West Gate Tunnel Project, provides a rationale of no more than 250 words for that name, and includes a valid email address with their Submission.
22.Entries must comply with Geographic Names Victoria requirements for the proposed name, including to:
- a) be relevant to the local area and community and not be used for another feature in Victoria;
- b) not be discriminatory;
- c) avoid using names of living people;
- d) avoid using commercial and/or business names;
- e) be written in English or recognised format of an Aboriginal language;
- f) be easy to pronounce, spell and write and must not exceed three words;
- g) avoid using directions in names i.e. north, south, east or west; and
- h) only use the surname of a person who is being commemorated and initials should not be used.
23.A limit of one entry per person applies, unless a written request is made to the Promoter to edit an already submitted entry. Persons who use multiple addresses or aliases will be ineligible for a Prize.
24.There is no entry fee for making a Submission or for participation in the Draw.
25.By submitting an entry, entrants acknowledge and agree they may be required by the Promoter to participate in photo or video recordings realted to promotion of the West Gate Tunnel Project.
Other
26.The Promoter accepts no responsibility for late, lost or misdirected entries or other communications.
27.The proposed tunnel names and rationale contained within all entries become and remain the property of the Crown in the right of the State of Victoria upon submission. By making a Submission, eligible entrants assign to the State of Victoria all rights, including intellectual property rights, in the proposed tunnel name and rationale contained within the entry. Entrants acknowledge that the State of Victoria owns all rights in the proposed tunnel name and rationale contained within entries submitted to the Promoter. Entrants consent to the Promoter dealing with an entrant’s proposed tunnel name and rationale in any way (including copying, modifying, adapting, publishing, or communicating the entry, or allowing a third party to do so) which may otherwise infringe the moral rights of the entrant.
28.The Promoter reserves the right to verify the validity of entries, prize claims and entrants (including an entrant’s identity, state of residence, school or age). The Promoter may, in its absolute discretion, disqualify any entrant who the Promoter believes to have submitted an entry or prize claim that is not a valid entry or is otherwise not in accordance with these terms and conditions, or who tampers with the entry process. An entry that is incomplete, indecipherable, illegible, contains explicit or otherwise offensive language or is non-compliant with these terms and conditions is invalid and will not be accepted or considered. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
29.Prizes are not transferable, not exchangeable and cannot be redeemed for cash. If a Prize or any element of a Prize is unavailable for any reason, the Promoter and Transurban Limited (or its associate) may substitute for that Prize, or an element of that Prize, another item of equal or higher value as determined by the Promoter (in its sole and absolute discretion and subject to all relevant legal requirements) in consultation with Transurban.
30.The decision of the Promoter is final and binding; no correspondence will be entered into.
31.Personal information is collected, used and disclosed by the Promoter for purposes including administering the Submissions or the Draw, complying with applicable laws (such as laws relating to running competitions) and announcing and contacting winners. The information may be disclosed to third parties who are assisting in administering the Submissions or the Draw, supplying prizes and otherwise as set out in these terms and conditions or permitted by law, including but not limited to the Promoter and Transurban. 32. The winner consents to the Promoter and Transurban using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media or marketing promotion for an unlimited period of time without remuneration for the purpose of promoting the Promotion (including any outcome). The winner also consents to the publication of their names in accordance with these Terms and Conditions.
33. The Promoter reserves the right, in its absolute discretion to:
- a) modify, suspend, terminate or cancel the Draw; or
- b) select a name for the tunnels which was not a valid Submission, either before or after winners of the Draw are announced.
34. Subject to clause 28, the Promoter and Transurban reserve the right to deal with any and all Submissions at its discretion. Each entrant acknowledges and agrees that this promotion is not a competition to win the right to name one or both of the West Gate Tunnel Project tunnels and nothing in these Terms and Conditions requires the Promoter or Transurban to use any Submission from the Promotion in determining the final name for the tunnels.
35. Nothing in these terms and conditions is intended to exclude, restrict or modify any right which an entrant may have under law which may not be excluded, restricted or modified by agreement (Your Legal Rights). Subject to Your Legal Rights, the Promoter is not liable for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant making a Submission or participating in the Draw, or using or permitting any other person to use the prize.
36. This promotion is governed by the law of Victoria, Australia.
