Freedom of Information requests

The Victorian Freedom of Information Act 1982 (FOI Act) gives you the right to apply for access to documents held by Victorian Government departments and agencies, including the Major Transport Infrastructure Authority (MTIA).

Under the FOI Act, you can also ask MTIA to correct or amend information it holds about you where it is inaccurate, incomplete, out of date or misleading.

When we refer to 'MTIA', we mean MTIA and each of its 3 Project Offices:

  • Level Crossing Removal Project
  • Major Road Projects Victoria (incorporating Big Build Roads, West Gate Tunnel Project and North East Link)
  • Rail Projects Victoria.

(together MTIA's Project Offices).

Before you make a request for access

We encourage you to check if the information or document you are seeking is already publicly available such as in the Department of Transport and Planning annual report, our FOI Information Statements or elsewhere on this website.

Where you cannot find the information or document you are seeking, we encourage you to call our Contact Centre on 1800 105 105 or email the relevant contact listed on this page and ask if the information or document you are seeking is available or can be provided to you.

In certain instances, we will be able to provide you with the information you are seeking without requiring you to make a formal request for access.

Making a Freedom of Information request

What you need to provide to MTIA

To lodge a valid FOI request, you must provide MTIA with:

  • a written request specifying which documents you seek access to
  • an application fee of $31.80 (as at 1 July 2023) payable by cheque to the Department of Transport and Planning or by credit card through the Victorian Government Freedom of Information Online request portal. Alternatively, you may request that the application fee be waived by providing evidence of financial hardship (such as a copy of your health care card).

If you are seeking access to documents containing personal affairs information (Document affecting personal privacy) held by MTIA about yourself or someone else, please also provide:

  • photo ID (if you are seeking access to documents containing information about you)
  • if you are seeking access to documents containing information about someone else, a signed authority from that person permitting you to receive documents containing their personal affairs information.

Online portal

You can also make an FOI request online using the Department of Justice and Community Safety Freedom of Information portal. You will need a credit card to complete this application online. Select the 'Department of Transport and Planning' as the agency or organisation you wish to seek documents from.

Please note that if you apply through the portal, your request will not be received by MTIA immediately as the Department of Justice and Community Safety will need to redirect it to MTIA.
