Terms and Conditions – Colouring Competition August 2025

Participation

  1. This competition (Competition) is conducted by Major Road Projects Victoria (MRPV), a division of the Victorian Infrastructure Delivery Authority, an administrative authority in relation to the Department of Transport and Planning ABN 69 981 208 782 and  Acciona Construction Australia Pty Ltd of Level 3, 11-29 Eastern Road, South Melbourne, VIC 3205, ACN: 618 030 872, MACA Civil Pty Ltd of Level 3, 216 St Georges Terrace, Perth, Western Australia 6000 ACN: 146 021 347 and AECOM Australia Pty Ltd of Level 8, 540 Wickham Street, Fortitude Valley, Queensland 4006, ACN 093 846 925, together M80RRA (Promoter).
  2. The Promoter and MRPV must declare all conflicts of interest – actual, potential, and perceived. The Promoter and MRPV will be required to declare any conflicts of interest that exist or are likely to arise in the performance of their duties as part of the Competition.
  3. There is no entry fee for the Competition.
  4. The Competition is run in conjunction with the following local participating primary schools, (Participating Primary Schools) located in Bundoora, Greensborough, and Watsonia:
    • Concord School (Watsonia and Bundoora Campus);
    • St Mary’s Parish Primary School (Greensborough); and
    • Watsonia Primary School.
  5. Entry to the Competition constitutes acceptance of these terms and conditions.
  6. The Competition is only open to Eligible Entrants, being an individual who, at the time of entry:

    (i) is an enrolled student in Prep to Grade 6 at one of the Participating Primary Schools; and

    (ii) is not a child or sibling (whether full, half, step or by adoption) of an employee associated with the Promoter or MRPV.

  7. Competition entry opens at 12.00am Monday 4 August 2025 and closes at 11.59pm Friday 29 August 2025 (Entry Period).
  8. All times and dates are times and dates in Melbourne, Australia. Time of receipt of electronic communications by the Promoter is in accordance with section 13B of the Electronic Transmissions (Victoria) Act 2000.

    Entry

  9. To enter, an Eligible Entrant must follow the entry instructions in these conditions.
  10. The Eligible Entrant must, during the Entry Period:

    (i)      complete a colouring page and form by:

    (a) successfully completing a hard copy form available at the Participating Primary School; and

    (b) leaving that form in a box at the Participating Primary School for collection by the Promoter at the end of the competition.

  11. The Promoter and MRPV take no responsibility for any late or misdirected entries or for any delays or failures in any telecommunications service or equipment.
  12. Skill plays no part in determining the winners.
  13. An Eligible Entrant may enter the Competition only once within the Entry Period.
  14. Any entry received after the expiry of the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries. Validity of entries and selection of entries is at the sole discretion of the Promoter.
  15. Eligible Entrants consent to the Promoter using their full name in the event that they are a winner for promotional purposes.
  16. By entering the Competition, the Eligible Entrant grants the Promoter and MRPV, and anyone acting on their behalf, an unrestricted, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry for any purpose in any media (including print and digital), without notice, compensation, restriction on use, attribution or liability. Eligible Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
  17. The Promoter will collect all physical entries from the Participating Primary Schools after the Entry Period. Upon collection, all entries become the property of the Promoter.
  18. The winners will be chosen by vote by a panel from the Promoter within [21 business days] of the end of the Entry Period. If the winning entry is invalid, that entry will be disregarded, and the Prize (as defined in condition 27) will be awarded by choosing the next valid entry in accordance with these Terms and Conditions.
  19. The Promoter will notify the winners by email to the email address provided with the entry.
  20. In the event that a prize winner is unable to be contacted within seven (7) days of the date of the draw, the Promoter will redraw another winner for the unclaimed Prize. If a Prize is not claimed within one (1) month of the date of the draw, another winner will be redrawn. The re-drawn Prize winner will be notified as set out in above.
  21. All entries to the Competition may be subject to verification by the Promoter.
  22. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant fails to establish their entitlement to enter the Competition to the Promoter’s reasonable satisfaction.
  23. Any costs associated with accessing the Competition website are the responsibility of the person seeking access and are dependent on the internet service provider used.

    Winner and Prize

  24. The Promoter’s decision is final, and no correspondence will be entered into.
  25. If for any reason a winner does not contact the Promoter in accordance with condition 28, then the Prize will be forfeited.
  26. Total prize pool value is [$1500]. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  27. There will be a total of [42] winners, with [two winners] from each year level of each of the Participating Primary Schools. The winners will receive Prizes up to the value of [$35] consisting of [educational books, toys, stationery] (Prize).
  28. The winner will be required to accept the Prize within 3 business days of notification that they have won a Prize, either by email to the Promoter, or by another method agreed by the Promoter. The Promoter will deliver the Prize.

    General

  29. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable controls of the Promoter or MRPV (including by vandalism, power failures, natural disasters, acts of God, pandemics, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter or MRPV reserve the right to cancel, terminate, modify, suspend or recommence the Competition.
  30. The Promoter and MRPV assume no responsibility for:

    (i) any error, omission, interruption or delay in the operation or transmission of any communication sent to (or by) the Promoter or MRPV or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise;

    (ii) any theft, destruction, or unauthorised access to, or alteration of such communications;

    (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; and

    (iv) any incorrect or incomplete information which may be communicated in the course of administering this Competition (whether as a result of one of the foregoing causes or otherwise).

  31. Any attempt to cause damage to any website or the information on any website associated with this Competition or to otherwise undermine the fair and legitimate operation of this Competition may be a violation of criminal and civil laws.  The Promoter and MRPV reserve the right to seek damages to the fullest extent permitted by law in the event that any such attempt is made, whether or not that attempt results in any such damage, interference or undermining.
  32. All of the Promoter’s decisions are final and no correspondence will be entered into.
  33. To the full extent permitted by law, the Promoter, MRPV and their personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant in connection with the Competition or Prizes, including:
  34. any indirect, economic or consequential loss;
  35. any loss arising from a negligent act;
  36. any liability for personal injury or death.
  37. Nothing in these conditions is intended to exclude, restrict or modify an entrant’s rights under the Competition and Consumer Act 2010 (Cth).
  38. If any provision of these conditions is unenforceable for any reason, it will be severed, and the remaining provisions will remain in full force and effect.
  39. The Eligible Entrant’s personal information will be collected by or on behalf of the Promoter in accordance with the Victorian Infrastructure Delivery Authority Privacy Policy.
  40. The Promoter will collect and use the information to enable it to administer the Competition and contact its winner.  The personal information of the winner may be provided to others assisting in the conduct of the Competition.  Persons may contact the Promoter by post to 71 Gipps Street, Collingwood, VIC 3066 to request access to, or corrections of, any of their collected personal information that is held by the Promoter.  If an entrant does not provide accurate personal information, the Promoter may determine that they are not eligible to win a Prize.
