Terms and Conditions

The Pakenham Roads Upgrade Project – Pakenham’s Open for Business Spend and Win Promotion (Promotion) is being distributed by and on behalf of The State of Victoria, through VIDA Roads, a division of the Victorian Infrastructure Delivery Authority, an administrative office in relation to the Department of Transport and Planning, of Level 21, 180 Lonsdale Street, Melbourne ABN 69 981 208 782 (Promoter). Select businesses within the Pakenham Roads Upgrade Project (Project) area are invited to participate in the Promotion (Trader/s).

To encourage shopping during major works as part of the Racecourse Road Upgrade, the Promoter is offering customers who spend at least $10 per transaction at a participating Trader from 9am Monday 24 November 2025 to 5pm Friday 20 February 2026, chance to win a $100 VISA Gift card.  Customers who spend $100 per transaction have a chance to win a $1,000 VISA Gift card,

All entries go into a major prize draw to nominate their favourite not for profit organisation to receive $2000 (Major Prize Draw).

Terms and Conditions

1. The Promoter is Big Build Roads (BBR), part of Victorian Infrastructure Delivery Authority (VIDA), ABN 69 981 208 782, whose principal office is at Level 21, 180 Lonsdale Street, Melbourne VIC 3000.
2. This Promotion is being conducted in accordance with these ‘Pakenham Roads Upgrade Project – Pakenham’s Open for Business Spend and Win Promotion’ Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.

Promotion Period

3. This Promotion commences at 9am Monday 24 November 2025 and concludes at 5pm, Friday 20 February 2026 (Promotion Period).

   How to enter

4. Spend $10 or more at a Participating Store during the Promotion Period to win a prize pack valued at $100.
5. Spend $100 or more at a Participating Store during the Promotion Period to win a prize pack valued at $1000.
6. Submit a Promotion entry form with proof of purchase via our ‘Pakenham Roads Upgrade Project – Pakenham’s Open for Business Spend and Win Promotion’ online form. (Entry).

Eligibility

7. The Promotion is open to Victorian residents aged 18 years or over (Eligible Individuals).
8. The following are ineligible to enter and will not be Eligible Individuals:
   1. any employee, contracted staff or service provider of the Promoter or Participating Store; or
   2. any spouse, de facto spouse, parent, child, sibling or any other family member of an ineligible employee, contracted staff or service provider.

Not for profit criteria

9. Be an incorporated not-for-profit organisation or community group
10. Have an Australian Business Number (ABN) and provide an incorporation number
11. Hold current public liability insurance
12. Incorporated not-for-profit community organisations within the Cardinia Shire Council boundary and may include but are not limited to:

• Charities and trusts registered with the Australian Charities and not-for-profit Commission
• Australian Public Companies, such as companies limited by guarantee and/or shares (non-distribution of profits or dividends)
• Cooperatives
• Not-for-profit associations
• Registered Australian Bodies
• Aboriginal Community Controlled Organisations
• Gathering Places
• Organisations established under an Act of Parliament

Ineligible Applicants:

• For profit organisations
• Private sector organisations
• Organisations that derive income from gambling or are proposing to conduct activities that promote gambling.

Conditions of entry

13. It is a condition of entering the Promotion that Eligible Individuals who complete and submit a valid entry form (Entrants) agree:
    1. to the collection of their personal information and the holding of that information in the Promoter’s database for the purpose of this Promotion; and
    2. to the publication of their name as set out in clause 20 of these Terms and Conditions.
    3. to the Promoter using the Entrant’s name in the event they are a winner in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
14. There is no entry or participation cost for customers to participate in the Promotion.
15. Only one Entry will be granted for each transaction of $10 or more, regardless of the total value of the transaction (e.g. for a spend of $10 in a single transaction, one Entry will be granted. Similarly, for a spend of $100 in a single transaction, only one Entry will be granted).
16. Once a Winner is drawn, their Entry will be taken out from future draws during the Promotion Period with the exception of the Major Prize Draw.
17. Eligible Individuals may enter the Promotion more than once provided an Entry attaching evidence of a different and subsequent transaction to any previous Entry is submitted by an Entrant.
18. Traders who have previously received support from BBR are ineligible to participate in the Pakenham’s Open for Business Spend and win promotion.

Draw details

19. Eleven (11) $100 Prize winners and eleven (11) $1000 Prize Winners (Winner/s) will be randomly drawn by a VIDA Roads representative at the Project site office at 245 McGregor Road, Pakenham VIC 3810 on the following dates and times:
    1. Tuesday 2 December 2025 at 11am
    2. Tuesday 9 December 2025 at 11am
    3. Tuesday 16 December 2025 at 11am
    4. Tuesday 23 December 2025 at 11am
    5. Tuesday 13 January 2026 at 11am
    6. Tuesday 20 January 2026 at 11am
    7. Tuesday 27 January 2026 at 11am
    8. Tuesday 3 February 2026 at 11am
    9. Tuesday 10 February 2026 at 11am
    10. Tuesday 17 February 2026 at 11am
    11. Tuesday 24 February 2026 at 11am
    12. Major prize draw, Tuesday 24 February 2026 at 11am
    13. The Major Prize Winner will be selected randomly from the entire database/promotion at the time of the draw.
    14. The decision of the VIDA representative shall be final, and no correspondence will be entered into.
20. BBR will publish the names of the Winner/s online at https://bigbuild.vic.gov.au/pakenham-spend-and-win throughout the Promotion Period.
21. An incomplete, indecipherable or illegible Entry will be deemed invalid. If a drawn Winner cannot be identified, an additional Entrant may be drawn and substituted as the Winner.
22. The decision of BBR shall be final and no correspondence will be entered into.

Winner notification

23. Winners will be advised by phone within 7 days of a Draw Date and will be provided with details of how to collect the Prize.
24. Winners must claim their Prize within 14 days of the draw, at a location to be nominated by the Promoter.
25. The Promoter is not responsible for any costs associated with collection of the Prize.
26. If a Prize is not claimed within 14 days of the draw, BBR reserves the right to draw a new substitute Winner for that Prize.
27. Any winner of a prize may, at the discretion of the Promoter, have their name published at the  https://bigbuild.vic.gov.au/pakenham-spend-and-win

Prizes

28. Eleven (11) winners will receive one prize pack, consisting of a $100 Visa Gift card.
29. Eleven (11) winners will receive one prize pack, consisting of a $1,000 Visa Gift card.
30. One (1) Major Prize winner will be able to nominate a not-for-profit organisation to receive $2,000
31. Total prize pool $14,100

General

32. The Promoter reserves the right to cancel all or any part of the Promotion at any time.
33. The Promoter is not responsible for the condition/quality of any goods or services offered by a Participating Store in relation to the Promotion.
34. The Promoter reserves the right, at any time, to
    1. verify the validity of Entries (including contacting Participating Stores) and Entrants (including Entrant’s identity, age and place of residence or employment); and
    2. disqualify any Entrant who:
       • submits an Entry that is not in accordance with these Terms and Conditions; or
       • tampers with the Entry process.
35. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
36. Prizes are not substitutable, exchangeable, or transferable and cannot be redeemed for cash.
37. Any additional expenses incurred by Winners other than those outlined in these Terms and Conditions, are the responsibility of the Winners.
38. The Promoter accepts no responsibility whatsoever for late, misplaced, lost or ineligible Entries. The Promoter will not be liable for any loss or damages whatsoever (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the Promotion, except for any liability which cannot be excluded by law.
39. The Promoter’s inclusion of a Participating Store in the Promotion does not mean that the Promoter in any way warrants or makes any representations as to the feasibility of, or assumes responsibility for, or has any obligations in relation to, the goods or services offered by the Trader.

Privacy

40. Personal information collected, used and disclosed in connection with the Promotion is subject to the Promoter’s Privacy Policy.

    Force Majeure

41. If for any reason the Promotion is not capable of running as planned (including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupts or affect the administration, security, fairness, integrity or proper conduct of this Promotion) the Promoter reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the Promotion. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the Promotion. The Promoter reserves the right to modify these Terms and Conditions at any time and to cancel or amend the Promotion at any time without notice.
