Submitting an entry to the Competition is deemed acceptance of these terms and conditions of entry. Entries must comply with these terms and conditions to be valid (as determined by the Promoter in its absolute discretion).
The Promoter will conduct one promotion, with the following prize to be awarded to two recipients: a VIP experience for one (1) winning entrant, plus four (4) friends or family members, to attend a VIP tunnel boring machine experience with exclusive access to the massive pieces of machinery and a behind the scenes tour of the TBM launch site in Watsonia (the Competition) as set out in these terms and conditions.
The Competition commences at 12.01am AEST on Monday 29 April 2024 and closes at 11:59pm AEST on Sunday 19 May (Promotional Period).
The promoter of the Competition is Major Road Projects Victoria (a division of the Major Transport Infrastructure Authority, an administrative office in relation to the Department of Transport and Planning), ABN 69 981 208 782 of Level 25, 180 Lonsdale Street, Melbourne, VIC, 3000 (Promoter).
Officers, employees and immediate families of officers and employees of the Promoter, and the associated companies, agencies and contractors of the Promoter are ineligible to enter the Competition.
Employees (and their immediate families), contractors and suppliers of the Promoter, are ineligible to participate in this Promotion. a. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. b. Contractors means any persons, firm or entity contracted by the Promoter to provide any materials, products or services, including any subcontractors. c. Suppliers means any persons, firm or entity that supplies goods and services to the Promoter.
The Competition is open to residents of Victoria.
If a winner of the Competition is under 18 years of age, to accept the prize, the winner and/or their parent or legal guardian (as required by the Promoter) must sign a release form provided by the Promoter: a. confirming acceptance of these terms and conditions; b. in the case of parents/guardians, accepting full responsibility for the winner in respect of the prize; c. allowing the first name of the winner to be published on the Promoter’s website and affiliate websites and social media channels; and d. allowing the winner to be filmed and photographed in accordance with paragraph 9, and if that release form is not provided within 14 days of the entrant being notified of the winning entry, the prize will be forfeited, and the Promoter may select another winner for the prize.
A limit of one entry per person applies, unless a request is made to the promoter to edit an existing entry.
By submitting an entry, entrants acknowledge and agree they may be required by the Promoter to participate in photo or video recordings including as part of the launch awarded as prizes and the public announcement(s) of the TBM name(s), as set out in these terms and conditions.
There is no entry fee for the Competition.
Entries can be submitted to the Promoter online at northeastlink.vic.gov.au/tbm-naming during the Promotional Period by completing the online entry form.
This is a game of skill.
To enter the Competition, entrants must submit a valid entry to the Promoter during the Promotion Period which nominates a female name for one (1) of two (2) TBMs and provides a rationale for that female name (with a word limit of 100 words). The entrant cannot choose which TBM they are submitting their name for and winners will be notified by either the supplied phone number or email address provided on the entry form.
In the event of a selected name being nominated multiple times, each entry will be assessed based on the literary and creative merit of the rationale provided (and, if applicable, a single winner will be determined by the Promoter on that basis).
In the event that an entrant is not able to be contacted to be awarded their prize and/or an entrant does not respond to the Promoter within 14 days of being notified of the winning entry by the Promoter, an alternative submission will be chosen to receive the prize set out in paragraph 2.
All entries become and remain the property of the Crown in the right of the State of Victoria upon submission. By entering a Competition, eligible entrants assign to the State of Victoria all rights, including intellectual property rights, in the entry including suggested Tunnel Boring Machine names. Entrants acknowledge that the State of Victoria owns all rights in entries submitted to the Promoter, including Tunnel Boring Machine names. Entrants consent to the Promoter and the owners or operators of the Tunnel Boring Machines dealing with an entrant’s entry in any way (including copying, modifying, adapting, publishing, or communicating the entry, or allowing a third party to do so) which may otherwise infringe the moral rights of the entrant.
The Promoter reserves the right to verify the validity of entries, prize claims and entrants (including an entrant’s identity, state of residence or age). The Promoter may disqualify any entrant who submits an entry or prize claim that is not a valid entry or is otherwise not in accordance with these terms and conditions, or who tampers with the entry process. An entry that is incomplete, indecipherable, illegible, contains explicit or otherwise offensive language or is non-compliant with these terms and conditions is invalid and will not be accepted or considered. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter accepts no responsibility for late, lost or misdirected entries or other communications.
Winning entries will be determined by the Promoter in its absolute discretion. The Promoter reserves the right to revoke a prize at any time (in its absolute discretion). The Promoter’s decision in relation to any aspect of the Competition will be final and binding on every person who enters.
The prize awarded in paragraph 2 is not transferable and not redeemable for cash.
Personal information is collected, used and disclosed by the Promoter for purposes including administering the Competition, complying with applicable laws (such as laws relating to running competitions) and announcing and contacting winners. The information may be disclosed to third parties who are assisting in administering the Competition, supplying prizes and otherwise as set out in these terms and conditions or permitted by law. The Promoter reserves the right, in its sole discretion, to modify, suspend, terminate or cancel the Competition.
Nothing in these terms and conditions is intended to exclude, restrict or modify any right which an entrant may have under law (including the Australian Consumer Law), and any consumer guarantee relating to goods or services under the Australian Consumer Law which may not be excluded, restricted or modified by agreement (Your Consumer Rights). Subject to Your Consumer Rights, the Promoter is not liable for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Competition or winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability that cannot be excluded by law or that would cause any part of this clause to be void or unenforceable.
This promotion is governed by the law of Victoria, Australia.
