Participation

  1. This competition (“Competition”) is conducted by Decmil Southern ABN 58 116 776 991 on behalf of the VicConnect Alliance, of Level 9, 30 Convention Centre Place, South Wharf, Melbourne, Victoria 3006 (“Promoter”).
  2. The Promoter must declare all conflicts of interest – actual, potential, and perceived. The Promoter will be required to declare any conflicts of interest that exist or are likely to arise in the performance of their duties as part of the Competition.
  3. There is no entry fee for the Competition.
  4. Entry to the Competition constitutes acceptance of these conditions.
  5. The Competition is only open to Eligible Entrants. An “Eligible Entrant” is an individual who, at the time of entry:
    1. is a current resident of Victoria aged 18 years or older;
    2. is not an employee of the Promoter, Rail Projects Victoria, the Major Transport Infrastructure Authority or agencies directly associated with the Competition or with the provision of the prize (“Prize”); and
    3. is not a spouse, de facto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
  6. The Competition entry opens at 8.00am 14 July 2023 and closes at 11.59pm on 11 August 2023 (“Entry Period”)

  7. The Promoter may extend the Entry Period in its sole and absolute discretion by providing reasonable notice on the Gippsland Line Upgrade section of the Victoria’s Big Build website, prior to the expiry of the Entry Period.
  8. All times and dates are times and dates in Melbourne, Australia Time of receipt of electronic communications by the Promotor is in accordance with section 13B of the Electronic Transmission (Victoria) Act 2000.

Entry

  1. To enter, an Eligible Entrant must follow the entry instructions in these conditions.
  2. The Eligible Entrant must, during the Entry Period:
    1. Complete an application form by:
      1. Scanning a QR code located on the bottom of the Drouin to Moe July - September Works Notice and successfully completing the online application on the Gippsland Line Upgrade section of the Victoria’s Big Build website
  3. The Promoter takes no responsibility for any late or misdirected entries or for any delays or failures in any telecommunications service or equipment.
  4. Skill plays no part in determining the winners of the Competition.
  5. An Eligible Entrant may enter the Competition only once within the Entry Period.
  6. Any entry received after the expiry of the Entry Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.
  7. Validity of entries and selection of entries is at the sole and absolute discretion of the Promoter.
  8. Eligible Entrants consent to the Promoter using their full name in the event that they are a winner for promotional purposes.
  9. Online applications will automatically close at the end of the Entry Period.
  10. All entries to the Competition will go into a random draw. The first valid entry will be randomly drawn within seven (7) days of the end of the Entry Period and will win a Prize. If the winning entry is invalid, that entry will be disregarded and the Prize will be awarded by drawing the next valid entry in accordance with these Terms and Conditions.
  11. The Promoter will notify any winner by an email to the email address provided with the entry.
  12. In the event that a winner is unable to be contacted within seven (7) days of the date of the draw, the Promoter will redraw another winner for the unclaimed prize. If a prize is not claimed within one (1) month of the date of the draw, another winner will be redrawn. The re-draw winner will be notified as set out in clause 19 above.
  13. All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an Eligible Entrant for any reasonable costs incurred in complying with this condition. An Eligible Entrant must deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of age, employment, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an Eligible Entrant must deliver requested copies within seven (7) calendar days of being asked to do so. At the Promoter’s request, an Eligible Entrant must, also within seven (7) calendar days of being asked, allow the Promoter to inspect and copy the original of any such document.
  14. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant:
    1. fails to establish their entitlement to enter the Competition to the Promoter’s reasonable satisfaction;
    2. fails to produce documents as required by condition 13 or produces document(s) that, in the Promoter’s reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way;
    3. in the Promoter’s reasonable opinion, tampers with the entry process or benefits from such tampering; or
    4. in the Promoter’s reasonable opinion, submits an entry which is not in accordance with these conditions.
  15. If an Eligible Entrant does not provide accurate personal information to the Promoter’s reasonable satisfaction, the Promoter may determine in its sole and absolute discretion that they are not eligible to win a prize.
  16. Any costs associated with accessing the Competition website are the responsibility of the person seeking access and are dependent on the Internet service provider used.

Winner and prize

  1. The Promoter’s decision is final, and no correspondence will be entered into.
  2. If for any reason a winner does not contact the Promotor in accordance with clause 20, then the prize will be forfeited.
  3. The total prize pool value is $200. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  4. There will be a total of 1 winner. The winner will receive a $100 voucher for Gumbaya World.
  5. The winner will be required to provide an Australian postal address within 3 business days of notification that they have won a prize, either by email to the Promoter, or by another method agreed by the Promoter. The Promoter will send the prize to the Australian postal address provided.
  6. A right to receive the prize is not transferable or exchangeable and cannot be taken as a monetary payment.
  7. Gift vouchers are not redeemable for cash or credit and cannot be resold or exchanged.

General

  1. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable controls of the Promoter (including by vandalism, power failures, natural disasters, acts of God, pandemics, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition.
  2. The Promoter assumes no responsibility for:
    1. any error, omission, interruption or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise;
    2. any theft, destruction, or unauthorised access to, or alteration of such communications;
    3. any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; or
    4. any incorrect or incomplete information which may be communicated in the course of administering this Competition (whether as a result of one of the foregoing causes or otherwise).
  3. Any attempt to cause damage to any website or the information on any website associated with this promotion or to otherwise undermine the fair and legitimate operation of this Competition may be a violation of criminal and civil laws.The Promoter reserves the right to seek damages to the fullest extent permitted by law in the event that any such attempt is made, whether or not that attempt results in any such damage, interference or undermining.
  4. All of the Promoter’s decisions are final and no correspondence will be entered into.
  5. To the full extent permitted by law, the Promoter and its personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant in connection with the Competition or prizes, including:
    1. any indirect, economic or consequential loss
    2. any loss arising from a negligent act; or
    3. any liability for personal injury or death.
  6. Nothing in these conditions is intended to exclude, restrict or modify an entrant’s rights under the Competition and Consumer Act 2010.
  7. If any provision of these conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
  8. Entrant’s personal information will be collected by or on behalf of the Promoter in accordance with the Major Transport Infrastructure Authority (MTIA) Privacy Policy
  9. The Promoter will collect and use the information to enable it to administer the Competition and contact its winner.The personal information of the winner may be provided to others assisting in the conduct of the Competition.
  10. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter.
